Today, Harvey Weinstein’s lawyers succesfully argued the dismissal of sexual battery charges in Los Angeles, CA on the grounds of the expiration of the statute of limitations.
Weinstein, who still faces 10 counts of rape and sexual assault charges, was extridited from New York to California to stand before a judge. Weinstein is still serving a 23-year sentence in New York.
Judge Lisa B. Lench had dismissed the charge on July 29th but allowed prosecutors the chance to amend and refile charges. The attempt failed as the judge claimed that the prosecution failed to present facts to the grand jury proving that the 10-year statute of limitations had not expired.
But, the judge did open the possibility that prosecution could reconvene the grand jury but there has been no indication that the prosecution would do so.
