Texas Attorney General Ken Paxton filed a lawsuit against Meta, the company that owns Instagram.

Now, many enjoyable filters on Instagram and Facebook won’t be allowed to be used anymore in Texas. The suit states that the facial technology used by the company breaks Texas law and violates the rights of Texans.

In 2021, Meta stopped using the facial recognition feature. Paxton had stated that the company also didn’t receive users’ permission when using facial recognition.

Paxton cited that the filters violate the Texas Capture or Use of Biometric Identifier Act. This is because they learn a user’s face and can instantly tag or relate a person with an image without their approval.

However, filters that only change the color of an image or background will still be permitted.

“The technology we use to power augmented reality effects like avatars and filters is not facial recognition or any technology covered by Texas and Illinois law, and is not used to identify anyone. Nevertheless, we are taking this step to prevent meritless and distracting litigation under laws in these two states based on a mischaracterization of how our features work. We remain committed to delivering AR experiences that people love…,” stated Meta.
